OP Mail Terms of Service

These terms apply to the OP Mail email service. They are a contract between you and Azrak Group Ltd. Please read them before you subscribe.

In short. We provide you with a mailbox. Your mail belongs to you, we do not read it for advertising and we do not sell it. You pay monthly and can cancel at any time. If we get something wrong, your rights under UK consumer law still apply and nothing here takes them away.

1. Who we are and what these terms cover

OP Mail is provided by Azrak Group Ltd ("we", "us", "our"), a company registered in England and Wales with company number 16788982. Our registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

These terms govern your use of the OP Mail service at opmail.io, including the webmail interface, the account portal, and access over standard mail protocols. They apply instead of, and take precedence over, the general Azrak terms of service for anything relating to OP Mail.

By subscribing to or using OP Mail, you agree to these terms. If you do not agree to them, please do not use the service.

2. The service

OP Mail is a hosted email service. Depending on the plan you choose, it provides:

We do not show advertising in the service, we do not build advertising or marketing profiles from your mail, and we do not sell your data to anyone.

3. Your account

To use OP Mail you need an account. You must be at least 16 years old, or older if the law where you live requires it. If you are subscribing on behalf of an organisation, you confirm that you are authorised to accept these terms for that organisation.

You are responsible for keeping your sign-in credentials secure and for activity that happens under your account. Please tell us promptly at hello@opmail.io if you believe your account has been accessed by someone else.

You must give us accurate account and contact details, and keep them up to date. We may need to reach you about service, security or billing matters.

4. Early access

OP Mail is currently offered in early access. This means:

Early access does not reduce your legal rights, and it does not change our obligation to provide the service with reasonable care and skill.

5. Prices, payment and renewal

Prices are shown in pounds sterling on our pricing page and are charged monthly in advance unless we agree otherwise with you in writing.

VAT. No VAT is charged on our prices, because we are not currently registered for VAT. If that changes, we will tell you before it affects what you pay.

Your subscription continues month to month until you or we end it. If a payment fails, we will contact you and give you a reasonable opportunity to resolve it before we suspend or close the mailbox.

If we change our prices, we will give you at least 30 days' notice by email. The new price applies from your next billing period after that notice. If you do not want to continue at the new price, you can cancel before it takes effect.

6. Your right to change your mind

Because you buy OP Mail online, you normally have 14 days from the day your subscription starts to cancel and receive a refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right applies to consumers, not to businesses.

If you ask us to start providing the service during that 14 day period, and we do so, then:

To exercise this right, simply tell us at hello@opmail.io. You do not need to give a reason, and you do not need to use a particular form of words.

7. Cancelling and closing your account

You can cancel at any time, for any reason. Your subscription then runs to the end of the period you have already paid for, and is not renewed.

Before you go, you can export your mail, calendars and contacts. Your mail is yours and we will not hold it hostage. If you need help exporting, ask us and we will help.

After your account closes we delete your mailbox and its contents. See our Privacy Notice for how long that takes and what happens to backup copies.

8. Acceptable use

OP Mail is a mail service for genuine correspondence. You must not use it to:

We apply automated filtering to inbound and outbound mail to protect the service and its users from spam and abuse. This is a security and deliverability measure. It is not used to profile you or to target advertising.

9. Your mail and your data

Your mail, your calendars, your contacts and anything else you store in OP Mail remain yours. We do not claim ownership of them.

You grant us only the permission we need to run the service for you: to receive, store, transmit, index for your own search, back up and deliver your data, and to restore it if something goes wrong.

We do not read your mail except where it is strictly necessary to do so, for example to investigate a specific technical fault you have reported to us, to respond to a credible abuse or security incident, or where the law requires it. Our Privacy Notice explains this in full.

10. Availability and support

We aim to keep OP Mail available at all times, and we will provide it with reasonable care and skill. We do not promise that the service will be uninterrupted or entirely free of faults.

We may need to carry out maintenance. Where we can plan it, we will try to do so at times likely to cause the least disruption, and we will tell you in advance where the impact is significant.

Support is available by email at hello@opmail.io. We aim to respond promptly during UK business hours.

11. Suspension and termination by us

We may suspend or close your account if you materially breach these terms, in particular the acceptable use section, or if we are required to do so by law, or if non-payment remains unresolved after we have contacted you.

Except where the law prevents us or where a delay would cause real harm to others, we will tell you what the problem is and give you a fair opportunity to put it right before we suspend or close your account. Where we do close an account, we will give you a reasonable opportunity to export your data unless the law prevents it.

We may also withdraw the service as a whole. If we do, we will give you at least 60 days' notice by email and refund any period you have paid for but not received.

12. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any breach of your statutory rights as a consumer.

We are not liable for loss of profit, loss of business, business interruption, or loss of business opportunity where you use the service for business purposes rather than as a consumer.

Subject to the two paragraphs above, our total liability to you in connection with the service in any 12 month period is limited to the amount you paid us for the service in that period.

Email depends on networks and systems outside our control, including the mail servers of the people you correspond with. We are not responsible for failures caused by those systems, but we will help you investigate where we reasonably can.

13. Your statutory rights

If you are a consumer, you have legal rights under the Consumer Rights Act 2015. In particular, a digital service must be supplied with reasonable care and skill, must match its description, and must be fit for any purpose you told us about before you subscribed.

Nothing in these terms affects those rights. If anything here conflicts with them, your statutory rights prevail. You can get free, impartial advice from Citizens Advice.

14. Changes to the service and these terms

We may improve and change the service over time. Where a change materially reduces the functionality you are paying for, we will give you at least 30 days' notice by email, and you may cancel without penalty and receive a refund for any period you have paid for but not received.

We may also update these terms, for example to reflect changes in the law or in how the service works. We will post the updated version here and change the date at the top. Where the change is material we will tell you by email before it takes effect.

15. Governing law

These terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts there.
